THIS TERMS OF USE AGREEMENT (the “Agreement”) constitutes a legally binding agreement by and between DESIGN TITAN, LLC, a limited liability company organized under the laws of the state of Maryland (“Design Titan”) and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of Design Titan’s website: https://www.designtitan.com/ (the “Website”) and any other media form, channel, mobile website or mobile application related, linked or otherwise connected thereto.
The Website and all Content and Marks are owned by Design Titan and protected by copyright and trademark laws. Content and Marks are provided for Client's personal use only. Client may not copy, reproduce, aggregate, republish, upload, post, display, encode, transmit, distribute, sell, license, or exploit the Content or Marks without express prior written permission from Design Titan.
If a Project incorporates third-party fonts needing a commercial license for Client to reproduce or display the Project, Design Titan will inform Client in writing. Client assumes responsibility for purchasing any required licenses.

By using the Website, Client represents having legal capacity to enter this Agreement and agrees to comply with all Terms of Use.
Client shall not access or use the Website for any purpose other than related to work performed by Design Titan on Client's behalf. Client shall refrain from prohibited activities listed in section 5 of this Agreement.
Any Client feedback or submissions shall be the property of Design Titan. Design Titan shall have unrestricted rights to use and disseminate submissions without compensation to Client.
Design Titan reserves the right to monitor, restrict, or terminate Client's access for violations of these Terms of Use. All decisions regarding management of the Website are at the sole discretion of Design Titan.
By using the Website, Client agrees to be bound by the Privacy Policy.
Design Titan reserves the right to deny refunds at its discretion without notice or liability to Client. Approved refunds may be subject to a 25% fee on any remaining contract balance.
Design Titan reserves the right to modify or discontinue any part of the Website at its discretion without notice or liability to Client.
Design Titan does not guarantee the Website will be continuously accessible. Connection issues shall not make Design Titan liable to Client for any resulting damages.
These Terms shall be governed by the laws of the State of Maryland without regard to conflicts of law.
Any legal action shall be brought in the state or federal courts of Maryland. The parties consent to jurisdiction and waive defenses of lack of personal jurisdiction and forum non conveniens.
The Website is provided "as is" and "as available". Design Titan disclaims all express or implied warranties including merchantability, fitness for purpose, and non-infringement.
Design Titan shall not be liable to Client for any damages arising from Client's use of the Website. Client agrees to defend, indemnify, and hold harmless Design Titan from any third party claims related to Client's use of the Website.
Client is solely responsible for all data transmitted related to Client's activity on the Website. Design Titan has no liability for lost or corrupted data.
Client consents to receive electronic communications from Design Titan and agrees such communications satisfy legal requirements to be in writing. Client agrees to the use of electronic signatures, contracts, and records.
